TERMS AND CONDITIONS FOR LOZO SERVICES LLC

I. SCOPE OF SERVICES

Lozo Services LLC provides demolition, hauling, trash pickup, and job site cleanup services (collectively, the "Services") to customers in Pennsylvania. By using our Services, you agree to these Terms and Conditions.

II. PAYMENT TERMS

a. Payment is due upon completion of Services, unless otherwise agreed in writing, in accordance with Pennsylvania's Prompt Payment Act (PA Cons. Stat. § 3931).

b. We accept cash, money orders; no Venmo, no checks.

c. A late payment fee of 10% may be applied to unpaid balances, not exceeding the maximum allowed by Pennsylvania law (PA Cons. Stat. § 506).

III. CANCELLATION POLICY

a. Cancellations must be made 48 hours prior to the scheduled Service, unless otherwise agreed upon, in accordance with Pennsylvania's Home Improvement Consumer Protection Act (PA Cons. Stat. § 7310).

b. Failure to cancel within the specified timeframe may result in a 50% cancellation fee, not exceeding the maximum allowed by Pennsylvania law (PA Cons. Stat. § 7310).

IV. LIABILITY AND INDEMNIFICATION

a. We shall not be liable for damages or losses arising from our Services, except to the extent caused by our gross negligence or willful misconduct, in accordance with Pennsylvania's Comparative Negligence Law (PA Cons. Stat. § 7102).

b. You agree to indemnify, defend, and hold harmless Lozo Services LLC from any claims, damages, or expenses arising from your use of our Services, in accordance with Pennsylvania's Indemnification Law (PA Cons. Stat. § 962).

V. PROPERTY DAMAGE

a. We shall not be responsible for damage to property not removed or cleaned up during our Services, in accordance with Pennsylvania's Property Damage Law (PA Cons. Stat. § 3301).

b. You are responsible for ensuring that all personal property is removed from the job site before our Services commence.

VI. ENVIRONMENTAL HAZARDS

a. You are responsible for disclosing any environmental hazards, such as asbestos or lead paint, prior to our Services, in accordance with Pennsylvania's Environmental Hazard Disclosure Law (PA Cons. Stat. § 7303).

b. We reserve the right to terminate Services if environmental hazards are discovered.

VII. SUBCONTRACTORS

a. Lozo Services LLC reserves the right to use subcontractors to perform all or part of the Services. All subcontractors engaged by Lozo Services LLC will be properly licensed and insured in accordance with Pennsylvania law.

b. You acknowledge and agree that subcontractors may be used to complete the Services, and that Lozo Services LLC will remain responsible for managing and overseeing the work performed by any subcontractors.

c. Any disputes or claims arising from work performed by subcontractors will be handled in accordance with Pennsylvania's Contractor and Subcontractor Payment Act (PA Cons. Stat. § 3931 et seq.).

d. Subcontractors and workers are authorized to perform only the Services explicitly requested by the person hiring Lozo Services LLC. They are not permitted to undertake additional tasks or modifications requested by homeowners or other individuals at the job site. This policy is in place to prevent potential issues due to homeowners' lack of knowledge about the home structure and to avoid unforeseen expenses.

VIII. FINALITY OF SERVICES

a. Once Services have been completed to your satisfaction and payment has been made, no changes, modifications, or reversals of Services will be accepted. This policy is in place to ensure clarity and finality in our service agreements.

b. Any concerns or issues with the completed Services must be raised immediately upon completion, and before final payment is made.

IX. POST-COMPLETION LIABILITY

a. Lozo Services LLC is not liable for any damages or claims of incomplete work discovered after a period of 30 days following the completion of the Services. This period allows sufficient time for any immediate issues to be identified and addressed.

b. You agree to inspect the work thoroughly upon completion and notify us of any concerns within this 30-day period. After this period, Lozo Services LLC will not be responsible for any claims related to the Services performed.

X. AVOIDANCE OF PAYMENT

a. Any attempts to avoid payment for the Services rendered will be addressed in accordance with Pennsylvania's Contractor and Subcontractor Payment Act (PA Cons. Stat. § 3931 et seq.).

b. Failure to make payment in accordance with the agreed terms may result in legal action to recover the owed amount, including but not limited to, filing a mechanic's lien on the property where the Services were performed, in accordance with Pennsylvania's Mechanic's Lien Law (PA Cons. Stat. § 1501 et seq.).

c. You agree to bear all costs associated with the collection of unpaid amounts, including but not limited to legal fees, court costs, and any other expenses incurred in the collection process.

XI. SAFETY AND HAZARD WARNING

a. The nature of our Services, including demolition, hauling, and trash pickup, involves inherent risks and hazards. It is important for you to stay clear of the work areas and avoid interacting with the debris or materials being handled.

b. To ensure safety, please adhere to the following guidelines:

i. Keep children and pets away from the work site.

ii. Do not attempt to handle or move any materials or debris yourself.

iii. Follow any safety instructions provided by our staff on-site.

iv. Wear appropriate protective gear if you need to be near the work area.

v. Notify us immediately if you observe any unsafe conditions.

c. Lozo Services LLC is committed to maintaining a safe work environment and will take all necessary precautions to protect our workers and your property. However, you must also take responsibility for your own safety and the safety of others on your property.

XII. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.

XIII. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Lozo Services LLC and you, superseding all prior negotiations, understandings, and agreements.

XIV. CHANGES TO TERMS AND CONDITIONS

We reserve the right to modify or update these Terms and Conditions at any time without notice, in accordance with Pennsylvania's Unfair Trade Practices and Consumer Protection Law (PA Cons. Stat. § 201-1).
